Dealing With The Pessimists
When dealing with local business doers, this question may
raise: why should I register my trademark?
You may have dealt with this question when explaining the
importance, or even the urgency, of trademark registration. The remark does not
only come from those in small businesses, those who earn billions of income
from their business can also be such pessimistic.
Most of the time, the negativity raised as they might not yet
understand the importance and benefits of trademark registration. In addition,
specific to SME, there is an assumption that filing a trademark registration is
pricey. Also, those with such remark may not aware of what he/she had spent to build their businesses and
brands. Dealing with such question, instead of lecturing them about trademark
law, I think you want to ask them the following questions:
- Has it been more than a year marketing a product or service bearing a particular trademark?
- Does he/she mind if someone else is using the trademark?
- Had he/she been enjoying the financial benefits from using the trademark?
If the answers
to the questions are mostly yes,
explaining the urgency of registering a trademark is easier.
In a different
situation where you discuss trademark protection in Indonesia with those who
just getting started, you want to emphasize the importance of early filing in a
country applying first-to-file rule
as an integral part of their business plan. In this case, the best way to
convince them is a true story of late filing and its consequences.
