Tahun 2020 meninggalkan catatan menarik atas permohonan pendaftaran merek. Wabah COVID-19 rupanya membuat sebagian kecil orang berupaya mendaftarkan kata atau frase yang punya kaitan erat dengan wabah termaksud sebagai suatu merek. Berikut ini beberapa permohonan pendaftaran merek-merek dengan kata yang punya kaitan erat dengan wabah COVID-19: Corona Virus 19 COVID COVID-19 Patut dicatat bahwa beberapa permohonan pendaftaran merek dengan elemen kata terkait wabah tersebut telah ditolak oleh Pemeriksa Merek di Direktorat Merek dan Indikasi Geografis. BELAJAR DARI KASUS AYAM GEPREK

Beberapa waktu yang lalu ramai diberitakan putusan Mahkamah Agung atas sengketa merek BENSU. Ribut-ribut ini bermula dengan upaya hukum Ruben Onsu membatalkan merek-merek dengan unsur kata BENSU atas nama PT. Ayam Geprek Benny Sujono. Dalam gugatannya, Ruben menyatakan bahwa BENSU adalah singkatan dari namanya Ruben Onsu dan bahwa dialah pemilik pertama dan sah dari merek BENSU. Dalam tangkisannya, PT. Ayam Geprek Benny Sujono menyatakan bahwa BENSU merupakan singkatan dari Benny Sujono juga bahwa Ruben mengajukan permohonan pendaftaran dengan merek-merek BENSU dilandasi iktikad tidak baik. PT. Ayam Geprek Benny Sujono menggugat balik merek-merek BENSU milik Ruben untuk dibatalkan. Pada akhirnya, Mahkamah Agung memperkuat putusan Pengadilan Niaga yang berkeputusan mengabulkan sebagian gugatan rekonvensi untuk membatalkan merek-merek dengan unsur kata BENSU milik Ruben. Trademark Opposition In Indonesia

During a two months publication a trademark application can be opposed.   An opposition can be based on the following grounds: ·          similarity to a prior registration, ·          similarity to a well-known mark for similar or dissimilar goods/services, ·          bad faith, and/or ·          similarity to a legal entity name An opposition is submitted to the Directorate General of Trademark and Geographical Indications by way of a letter with copies of evidence attached. Letter of Consent

So you received a report that the trademark office will reject your trademark application. It said that the mark is similar to a prior registration or pending application. You have the opportunity to respond the provisional rejection. As the proprietor of the mark(s) is related to the client, you would think that a letter of consent will solve the matter. But, really?   In practice a l etter of consent will not improve the chances in overcoming a provisional rejection . The Indonesian trademark office is strict in their view that even related companies ,   e.g. in the same group ,  cannot give consent to another related company to overcome a citation. So is obtaining a letter of consent is a bad idea at all? Not really.   L etter of consent is useful to eliminate infringement risk in respect of the   cited mark (s).
