E-court for commercial matters and intellectual property

Indonesia has introduced new rules to make it easier for people to protect their intellectual property. The Commercial Court of the District Court of Central Jakarta has issued a Decree No. W10-U1/05/KP.00.3/I/2023, which says that people must now register online with the court to enforce their intellectual property rights. This new system, called e-court, will take effect on January 24, 2023, and covers disputes related to commercial matters and intellectual property. With e-court, people can register their cases online, make payments electronically, receive electronic summons, and carry out legal proceedings through the internet. However, people can still go to court in person if they prefer. This new decree is in response to Supreme Court Regulation (“PERMA”) Number 1 of 2019, which outlines how e-court systems should be used in court proceedings. 2022: Indonesia Masih Dalam Priority Watch List – Satgas yang Tidak Dianggap

27 April 2022 lalu United States Trade Representative (USTR) menerbitkan 2022 Special 301 Report on Intellectual Property Protection Enforcement. Dalam rapor tahunan atas upaya perlindungan dan penegakan hukum di bidang Kekayaan Intelektual ini, Indonesia masih tetap dalam Priority Watch List (PWL) alias belum naik kelas ke Watch List (WL). Penjelasan kami tentang apa itu PWL dan WL dapat dilihat di sini dan di sini . Pada tulisan tersebut kami sampaikan upaya-upaya yang sudah, sedang dan akan diambil oleh pemerintah Indonesia via Direktorat Jenderal Kekayaan Intelektual (DJKI) untuk menghapus Indonesia dari PWL.  Rupanya upaya-upaya yang telah dilaksanakan Pemerintah belum cukup untuk menggeser posisi Indonesia dari PWL ke WL.
